September 3, 2015- As a lawyer practicing exclusively in personal injury law  and only representing injury victims for more than 20 years I have seen a lot of people without lawyers ruin very good cases.  It is therefore extremely important to get yourself a good lawyer as early as possible.  Personal injury lawsuits and ICBC injury claims can become very complex both legally and medically.  A good personal injury lawyer will save you the fear, frustration and financial risk  by knowing  how to prosecute your injury claim effectively and efficiently while you focus on getting better. Here are, from my experience, three qualities that most top personal injury lawyers have in common:
1.  Legal expertise in personal injury claims and a working experience in personal injury litigation.  This potent combination of book knowledge and hands on experience can be worth its’ weight in gold.  Experienced personal injury lawyers will likely expect a higher percentage or hourly rate but, in my experience, they can usually obtain a better result for the injury claimant in the long run. Check out my post on how personal injury lawyers are paid.
2.  Most will restrict their legal practice to only personal injury and ICBC injury claim matters so they can better keep up to date on the daily changes in the law and acquire an in depth understanding of the subject matter.  I am of the view as a lawyer that becoming familiar with one area of the law is critically important in our modern world of specialization. With our new and sophisticated rules of court  top lawyers in British Columbia can also represent any injury claimant no matter where they live.
3.  Most will have enough confidence in their skills to take your case on  a percentage of what is recovered and, if you have a bad case, they will  refuse to accept your case. The good lawyer knows that a bad case is a bad case and will not try to tell a potential client otherwise.
Having a law degree is only the first step in being able to apply the right legal strategy  to an injury case . As of December , 2013 there were over 13,000 lawyers in British Columbia and over 7,500  practice in the Vancouver area. In British Columbia there is no recognized special status or accreditation for “top personal injury lawyers” or lawyers that restrict their practice to ICBC claims. I can therefore understand why it would be difficult to find a good personal injury lawyer as not all lawyers in our Province have prosecuted a personal injury claim.
Unfortunately, word of mouth does not always yield the best results in finding a personal injury lawyer and you may not find a lawyer that has specific expertise in your type of injury. Read my post about finding a personal injury lawyer.
In the end make sure you feel good about the lawyer and feel comfortable asking questions.  You have to feel confident that your lawyer will give you proper legal advice and that he or she is on your side. Posted by Mr. Renn A. Holness
